Regulatory Tax Credit Changes Announced in 2015 Provincial Budget Have Passed Into Law

The 2015 Provincial Budget proposed changes to eligibility for the Ontario Interactive Digital Media Tax Credit (OIDMTC) to:

  • Focus the credit on entertainment products and on educational products for children under the age of 12;
  • Exclude certain products from OIDMTC support, such as search engines, real estate databases, and news and public affairs products;
  • Strengthen the rule that excludes promotional products; and
  • Improve certification by replacing the former development requirement with a rule based on the labour costs of the company developing the product.

These OIDMTC regulation changes passed into law on March 14, 2017, and the Ministry of Finance has posted a bulletin related to these OIDMTC changes.

The regulations that passed into law on March 14, 2017, also dealt with several film and television tax credits and clarified the following:

  • The 2015 Ontario Production Services and Computer Animation and Special Effects Transitional Fund will not be treated as assistance for purposes of the Ontario Film and Television Tax Credit (OFTTC) or the Ontario Production Services Tax Credit (OPSTC)  [a legislative change to clarify that the Transitional Fund would not be treated as assistance for the Ontario Computer Animation and Special Effects Tax Credit (OCASE) had previously passed into law];
  • Effective after December 31, 2008, government equity will not be treated as assistance for purposes of the OFTTC; and
  • Talk shows remain ineligible (as they have always been) for provincial tax credits.
